1. WHAT INFORMATION DO WE COLLECT?
Information you give us in the App
In Short: We collect the information you enter in the App and the content you create there.
Your account. When you open the App for the first time, it creates an account for you automatically. You do not need an email address or a password. Your account is identified by a random user ID.
Your profile. During onboarding and in the App we collect:
- your first name
- your birth date, birth time and birth place (used to create your astrological readings and soulmate portraits)
- the gender you are looking for: man, woman or anyone (used to create your soulmate portrait and readings)
- which part of the App interests you most (for example soulmate or past life)
Sensitive information: your partner preference. The gender you are looking for can reveal your sexual orientation, which is a special category of personal data. You choose it yourself on the preference screen during onboarding, and you can choose "anyone". We use it only to create your soulmate portrait and readings, and we send it to our AI providers OpenAI and Replicate (USA) for that purpose. Your interest in astrology and your birth details are not treated as special category data; we process them to provide the App. We do not collect information about your health or your racial or ethnic origin, and we do not process biometric data.
Content you create in the App. This includes entries in your love diary and journal, questions you ask in Ask the Universe or Tarot, love letters and your daily and extended guidance. We store this content in your account to show it back to you. Where a feature answers your question, we send the question to our AI provider OpenAI to create the answer.
Information about other people. In the Compatibility Check and in your Cosmic Circle you can enter another person's name and birth date, birth time and birth place. We use these details only to create the result you ask for, send them to OpenAI for that purpose, and store them in your account. Please only enter another person's details if they agree. If you are that person and want us to delete your details, contact [email protected].
Photos in the Compatibility Check. In the Compatibility Check you can add a photo from your photo library for yourself and for the other person. If you do, the App sends these photos to our servers (Google Cloud, USA) together with your request. Our server does not store or analyse the photos, does not pass them to any AI provider and does not use them to create content. We do not create biometric templates or use facial recognition. Soulmate portraits are created from text descriptions based on your details, never from a photograph.
Payment Data. Purchases (subscriptions and gems) are made through the Apple App Store or Google Play, which process your payment details under their own privacy policies. We never receive your payment card details. We use RevenueCat, Inc. (USA) to manage purchases. RevenueCat receives your purchase receipts, transaction history and subscription status, linked to your App user ID, so we can tell whether your subscription is active and unlock your purchases.
Usage and Device Data. When you use the App, we and our service providers automatically collect information such as your device type and operating system, app version, language settings, IP address, the screens you open and the features you use (see "Firebase Analytics" in Section 6), and crash reports.
Weather feature. To show the weather, the App sends the coordinates of your birth place, or of a city you choose, from your device to Open-Meteo (weather data) and to BigDataCloud (to turn the coordinates into a city name). Your device's IP address is transmitted with these requests. The App does not use your device's GPS location.
Notifications. If you allow it, the App schedules reminders on your device, for example for your daily reading. These reminders are created on your phone and no notification token is sent to us. You can turn them off in your device settings.
Information from third parties. We receive your purchase and subscription status from Apple, Google and RevenueCat to operate the Services.
Information we process on our websites
Website visits. When you visit our websites, our hosting provider Cloudflare, Inc. processes your IP address, browser type and operating system, the page requested and the date and time of access, so the page can be delivered and protected against attacks. Cloudflare also collects network error reports from your browser to detect delivery problems.
Download page (fated.date/get). This page sends you to the App Store or Google Play. It loads Google Ads conversion tracking from Google Ireland Limited when the page opens. On an iPhone, iPad or Android device it also records a conversion and then forwards you to the store. See Section 6.
Referral page (fated.date/r). If you open an invite link, the page shows the invite code and can copy it to your clipboard when you tap the button. The code is not stored by the website.
Creator tool (fated.date/create). Invited creators can use this page. There we process your invite code, birth date, birth time, birth place, the gender you are looking for and your IP address to create a sample soulmate portrait and profile on our servers (Google Cloud, USA) and with our AI providers, and to prevent misuse. Each generation is logged with these details and the result. The generated image is stored under a public link. The page loads the html2canvas script from cdnjs (Cloudflare) so you can save your result as an image.
Fonts. We host the fonts used on our websites ourselves. Your browser does not connect to Google Fonts or any other font provider when you visit our websites.
Emails. If you email us, we process your email address and the content of your message to answer you. Our brand mailbox forwards to Apple iCloud Mail, so Apple receives these emails.
2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve and administer our Services, for security and to comply with law.
We process your personal information for these purposes:
- To create and manage your account.
- To provide the App, including creating your astrological readings, soulmate portraits, compatibility results and answers from the details you provide, and storing your content so you can see it again.
- To process your purchases and manage your subscriptions.
- To answer your messages.
- To protect our Services, including preventing misuse, limiting the number of requests and keeping the App working.
- To improve our Services through app analytics and crash reports.
- To measure our ads on our download page.
- To comply with legal obligations and to establish, exercise or defend legal claims.
Do you have to give us your data? You are not legally obliged to give us your personal information. Without your birth details and partner preference we cannot create your readings and portraits.
Automated decisions. Our AI features create readings and images automatically, for entertainment only. We do not make decisions based solely on automated processing that have legal or similarly significant effects on you (Art. 22 GDPR).
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?
In Short: We process your personal information only when we have a legal basis to do so. Below we list the legal basis for each purpose.
If you are located in the EU or EEA, the General Data Protection Regulation (GDPR) requires us to explain the legal bases we rely on. We use the following legal bases:
- Account and providing the App (readings, portraits, compatibility checks, your content, the weather feature): account data, birth details, content you write. Legal basis: performance of a contract, Art. 6(1)(b) GDPR.
- Partner preference (the gender you are looking for): you choose to give it to us on the preference screen to receive your soulmate portrait and readings. Legal basis: Art. 9(2)(a) GDPR together with Art. 6(1)(b) GDPR. You can remove it at any time by deleting your account.
- Purchases, subscriptions and support: purchase and subscription status, user ID, your messages. Legal basis: Art. 6(1)(b) GDPR.
- Crash reports, security and misuse prevention: device data, error logs, request counts. Legal basis: Art. 6(1)(f) GDPR, our interest in a stable and secure App.
- App analytics (Firebase Analytics): usage events, app instance ID, user ID. Legal basis: Art. 6(1)(f) GDPR, our interest in understanding how the App is used and improving it. You can switch it off at any time in Settings.
- Website hosting and server logs: IP address, browser data, time of access. Legal basis: Art. 6(1)(f) GDPR, our interest in delivering and securing the website.
- Ad measurement on the download page (Google Ads conversion tracking): Google Ads identifiers, IP address, page visit. Legal basis: Art. 6(1)(f) GDPR, our interest in measuring whether our ads lead to app downloads.
- Creator tool: invite code, birth details, partner preference, IP address. Legal basis: Art. 6(1)(b) GDPR to create your result, and Art. 6(1)(f) GDPR, our interest in preventing misuse.
- Data you enter about other people (Compatibility Check, Cosmic Circle): name and birth details of the other person. Legal basis: Art. 6(1)(f) GDPR, our interest in providing the feature you asked for.
- Keeping transaction records: purchase records. Legal basis: legal obligation, Art. 6(1)(c) GDPR together with § 147 AO and § 257 HGB.
- Legal claims: data relevant to the claim. Legal basis: Art. 6(1)(f) GDPR, our interest in defending legal claims.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We share information with the service providers listed below to operate the Services. We do not sell your personal information.
Our service providers are:
- Google Ireland Limited / Google LLC (Firebase Authentication, Cloud Firestore, Cloud Functions, Cloud Storage and Firebase Analytics): login, database, servers, file storage and app analytics. Our server functions run in the USA (us-central1).
- OpenAI, L.L.C., USA: creating readings, compatibility results and answers to your questions from your birth details and inputs.
- Replicate, Inc., USA: creating portrait images from text descriptions. No photos are sent to Replicate.
- Functional Software, Inc. (Sentry), USA: crash and error reports from the App.
- RevenueCat, Inc., USA: purchase and subscription management.
- Apple and Google: app stores and payments.
- Cloudflare, Inc., USA: hosting and delivery of our websites, and the cdnjs script library used on the creator tool.
- Google Ireland Limited (Google Ads): conversion tracking on our download page.
- Open-Meteo (Switzerland): weather data for your birth place, your chosen city and your day of birth.
- BigDataCloud Pty Ltd, Australia: turns coordinates into a city name for the weather feature.
- OpenStreetMap Foundation (Nominatim), UK: finds the coordinates of your birth place.
- Apple Distribution International / Apple Inc. (iCloud Mail): receives emails you send to us, because our brand mailbox forwards to iCloud.
Every service provider that processes personal data on our behalf works under a data processing agreement with us. Our AI providers do not use your data to train their models.
We may also share information with professional advisers and authorities where required to comply with law, enforce our terms or protect rights, property or safety, and in connection with a merger, sale of company assets, financing or acquisition.
5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?
In Short: We are not responsible for the safety of any information that you share with third parties that we link to but are not affiliated with.
The Services may link to third-party websites, online services or mobile applications, such as the App Store and Google Play. Any data collected by third parties is not covered by this Privacy Notice. We are not responsible for the content or the privacy and security practices of any third parties. Please review their policies and contact them directly with any questions.
6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: On our websites we use one necessary cookie and, on the download page only, Google Ads conversion tracking. In the App we use Firebase Analytics, which you can switch off in Settings.
Necessary cookie. Pages that show our cookie banner set a first-party cookie named fated_cookie_consent that stores your choice for 12 months (strictly necessary, § 25(2) No. 2 TDDDG). These pages do not use analytics or marketing cookies. To change your choice, delete this cookie in your browser settings; the banner then appears again.
Google Ads conversion tracking (fated.date/get only). On our download page we use Google Ads conversion tracking by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, to measure whether our ads lead to app downloads. When you open the page, the Google tag loads, can store or read an identifier on your device (for example the _gcl_au cookie, up to 90 days) and transmits your IP address, device information and page visit to Google, including to Google LLC in the USA (EU-U.S. Data Privacy Framework). On an iPhone, iPad or Android device the page also sends a conversion event to Google before it forwards you to the store. The tag runs when the page opens; this page does not show our cookie banner. You can block it with your browser's tracking protection or an ad blocker, and you can object at any time by email to [email protected].
Firebase Analytics (App). In the App we use Google Analytics for Firebase (Google Ireland Limited) to understand how the App is used, for example which screens are opened and which features are used. Firebase stores an app instance identifier on your device and links usage events to your App user ID. Data may be transferred to Google LLC in the USA (EU-U.S. Data Privacy Framework). Firebase Analytics is switched on by default. You can switch it off at any time in Settings with the switch "Help improve the app".
Crash reports (App). We use Sentry to receive crash and error reports needed to keep the App working (§ 25(2) No. 2 TDDDG, Art. 6(1)(f) GDPR).
7. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?
In Short: Yes. We offer products that use artificial intelligence.
As part of our Services, we offer features that use artificial intelligence ("AI Products"), including AI-generated astrological readings, compatibility results, answers to your questions and AI-generated "soulmate" portrait images. Readings and answers are created with models from OpenAI, and portraits with image models run on Replicate. These providers process your inputs on our behalf only to create the output you request.
The inputs used to create your soulmate portrait are the details you provide (such as your birth date, time, place and partner preference), turned into a text description. We do not use any photograph of you to create these images, and we do not create a biometric template or use facial recognition. Our AI providers do not use your data to train their models.
AI-Generated Images. All "soulmate" portraits, faces and other imagery produced by the App are generated by artificial intelligence. They are fictional, computer-generated illustrations provided for entertainment only. They are not photographs of, and are not intended to depict, identify, predict or represent, any real, living or specific person, including any actual future partner. Any resemblance to a real person is purely coincidental.
8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?
In Short: Yes. Several of our service providers process your information in the USA and in other countries outside the EEA.
Our server functions run in the USA, and Google, OpenAI, Replicate, Sentry, RevenueCat, Cloudflare and Apple process your information in the USA. BigDataCloud processes data in Australia. For recipients certified under the EU-U.S. Data Privacy Framework, we rely on the adequacy decision of 10 July 2023 (Art. 45 GDPR). For all other recipients outside the EEA, including BigDataCloud (Australia), we use the EU Standard Contractual Clauses (Art. 46(2)(c) GDPR). The UK and Switzerland have adequacy decisions. You may request a copy of the relevant safeguards by contacting us at [email protected].
9. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as we need it for the purposes in this notice, unless the law requires us to keep it longer.
- Account and content data (profile, birth details, partner preference, readings, portraits, diary and journal entries, compatibility checks, questions and other content): for as long as your account exists. What account deletion removes is described in Section 16.
- Firebase Analytics data: for the retention period set in our Google Analytics settings, at most 14 months.
- Crash and error reports (Sentry): up to 90 days.
- Inputs sent to OpenAI: OpenAI may keep them for a limited time under its API data retention terms, for example for abuse monitoring.
- Website server logs: we do not store them ourselves; Cloudflare keeps them under its standard retention.
- Google Ads conversion data: under Google's retention rules; the _gcl_au cookie expires after up to 90 days.
- Creator tool generation logs (IP address, birth details, partner preference and result): for as long as we run the creator tool.
- Emails: for as long as needed to handle your request.
- Transaction records: up to 10 years under § 147 AO and § 257 HGB.
When we no longer need personal information, we delete or anonymize it.
10. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We protect your personal information with organizational and technical security measures.
We have implemented appropriate technical and organizational security measures to protect the personal information we process. However, no transmission over the internet and no storage technology can be guaranteed to be 100% secure, so we cannot guarantee that unauthorized third parties will never be able to access your information.
Portrait images. Images we generate for you, and images generated in the creator tool, are stored on Google Cloud Storage under a long link that contains a user ID or, for the creator tool, an invite code. Anyone who has this link can open the image without logging in, so only share it with people you trust.
11. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: Depending on your location, you have rights that give you access to and control over your personal information.
If you are located in the EEA or UK, you have the following rights: the right to access and receive a copy of your personal information (Art. 15 GDPR); to rectification (Art. 16) or erasure (Art. 17); to restrict processing (Art. 18); and to data portability (Art. 20). Where we process your information based on consent, you have the right to withdraw your consent at any time (Art. 7(3)); withdrawal does not affect the lawfulness of processing before the withdrawal.
Your right to object (Art. 21 GDPR). Where we process your data on the basis of our legitimate interests (Art. 6(1)(f) GDPR), you can object at any time for reasons arising from your particular situation (Art. 21(1) GDPR). We will then stop the processing unless we can show compelling legitimate grounds that override your interests, or the processing serves legal claims. If we use your data for direct marketing, you can object at any time without giving reasons, and we will stop (Art. 21(2) GDPR). Send your objection to [email protected]. You can switch off Firebase Analytics yourself in the App's Settings with the switch "Help improve the app".
Right to complain. You also have the right to lodge a complaint with a data protection supervisory authority. Our competent authority is Die Landesbeauftragte für den Datenschutz und für das Recht auf Akteneinsicht Brandenburg (LDA Brandenburg) (website: lda.brandenburg.de). You may also contact the supervisory authority in your country of habitual residence.
To exercise any of these rights, use the options in the App's Settings or contact us at [email protected]. We may need to verify your identity before responding to a request.
12. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate to signal that you do not want your online activity tracked. No uniform technology standard for recognizing and implementing DNT signals has been finalized, so we do not currently respond to DNT browser signals. If a standard for online tracking is adopted that we must follow in the future, we will describe that practice in a revised version of this Privacy Notice.
13. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: If you live in certain US states, you may have additional rights regarding your personal information.
If you live in a US state with a consumer privacy law, you may have the right to know what personal information we collect and why, to access, correct and delete it, to opt out of targeted advertising, sale and profiling, and to limit the use of sensitive information. We collect the categories in Section 1 for the purposes in Section 2. We do not sell your personal information for money. Our use of Google Ads conversion tracking on our download page may count as "sharing" for cross-context behavioral advertising under some US state laws; you can opt out by email to [email protected]. We use sensitive personal information (such as your partner preference) only to provide the features you request and not to infer characteristics about you. To use your rights, email [email protected]. You may also use an authorized agent. If we decline your request, you can appeal by replying to our answer with the subject "Appeal". We will respond within 45 days. We will not discriminate against you for using your rights.
14. DO WE MAKE UPDATES TO THIS NOTICE?
In Short: Yes, we update this notice as necessary to stay compliant with relevant laws.
We may update this Privacy Notice from time to time. The updated version is indicated by an updated "Last updated" date and is effective as soon as it is published on this page.
15. HOW CAN YOU CONTACT US ABOUT THIS NOTICE?
For all data protection questions, please email us at [email protected] or contact us by post at:
Dumke Ventures UG (haftungsbeschränkt)
Ebersprung 2
16321 Bernau
Germany
Managing Director (Geschäftsführer): Tom Dumke. Our full legal notice is available in our Impressum.
16. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?
You have the right to request access to the personal information we hold about you, details about how we have processed it, correction of inaccuracies, or deletion of your personal information. These rights may be limited in some circumstances by applicable law.
Export. In the App under Settings > Export Your Data you can download a copy of your main profile and soulmate data. For a full copy of all your data, email [email protected].
Deleting single entries. You can delete single soulmates and Cosmic Circle entries in the App. Other single items, such as a journal entry or a compatibility check, can be deleted on request by email to [email protected].
Deleting your account. When you delete your account in the App (Settings > Delete Account), we immediately delete your login, your profile (including your name, birth details and partner preference), your soulmates and love profile, your love insights, Cosmic Circle, daily alignments, journey content, past lives and gem history. This step does not remove the other content stored with your user ID, such as diary and journal entries, compatibility checks, questions, love letters and daily content, and it does not remove the portrait images we generated for you. After deletion this remaining data is no longer linked to a login. To have it deleted as well, email [email protected]. RevenueCat, Apple and Google keep purchase records under their own retention rules.
17. CHILDREN
Fated is intended for people aged 16 and over. We do not knowingly collect personal information from children under 16. If you believe a child under 16 has given us personal information, parents and guardians can contact us at [email protected] and we will delete it.
